Advocacy Trainer: Beta Testing Terms

These terms govern your participation in the private beta of Advocacy Trainer. You must accept them before beta access is enabled; your acceptance (including the version accepted and the date and time) is recorded. If you do not accept them, do not use the Service.

1. Definitions

1.1 "the Service" means the Advocacy Trainer web application at www.advocacytraining.co.uk, including all exercises, case papers, hearings, voice sessions, feedback outputs and related materials made available to you during the beta.

1.2 "Confidential Information" means all non-public information relating to the Service or the beta, including your access credentials and invite link, screenshots and screen or audio recordings of the Service, prompts and exercise materials, feedback outputs, pricing information, and the existence and content of any unreleased features.

1.3 "Feedback" means any suggestions, ideas, bug reports, survey responses, comments or other input you provide about the Service.

1.4 "the Owner" means Lextrapolate Limited (company no. 15711888) of 86-90 Paul Street, London, EC2A 4NE.

2. Beta status

2.1 The Service is a pre-release product provided for testing. It is provided "as is" and "as available".

2.2 The Service may change, be interrupted, or be withdrawn in whole or in part at any time without notice. Features, content and pricing seen during the beta may differ from any released product.

2.3 To the fullest extent permitted by law, the Owner gives no warranty as to the Service's availability, accuracy, performance or fitness for any purpose, and makes no commitment as to uptime or support response times. Nothing in these terms excludes liability that cannot lawfully be excluded.

3. Confidentiality

3.1 You must keep Confidential Information confidential and must not share it with anyone outside the beta group. In particular you must not share your access, screenshots, recordings, prompts, exercise materials, feedback outputs or pricing information with any third party.

3.2 You must not publish posts, reviews, articles, videos or social media content about the Service during the beta period without the Owner's prior written consent.

3.3 These confidentiality obligations do not apply to information that is or becomes public other than through your breach, or that you are required to disclose by law.

3.4 Your confidentiality obligations survive the end of your participation and the end of the beta for a period of two years.

4. Acceptable use

4.1 Your account is personal to you. You must not share your account or allow anyone else to use it.

4.2 The Service is provided for your personal advocacy training only. You must not use it for any other purpose.

4.3 You must not scrape, copy or bulk-extract content from the Service; reverse engineer, decompile or probe it; benchmark it against other products for publication; or use the Service or its outputs to build, train or improve a competing product.

4.4 You must not speak or type into the Service any real client information, any information about real cases or proceedings, or any other confidential or privileged information. Hearings are transcribed and transcripts may be reviewed under clause 8.1; use only the fictitious exercise materials provided. If you realise you have submitted such information by accident, stop the session and email chris@lextrapolate.com promptly so the relevant transcript can be deleted.

5. Feedback licence

5.1 The Owner may use your Feedback freely for any purpose, including improving and promoting the Service, without payment, attribution or restriction. You waive any claim to compensation for the use of Feedback.

5.2 Quotation of your Feedback with your name requires your separate consent (asked for in the feedback form).

6. Intellectual property

6.1 All rights in the Service, including the exercise materials, case papers, personas, prompts, software and feedback outputs, belong to the Owner or its licensors and remain so.

6.2 You are granted a limited, personal, non-transferable, revocable licence to use the Service and its outputs for your own training during the beta. No other rights are granted.

7. Fictitious content; no legal advice

7.1 All case papers, parties, firms, witnesses, judges and facts in the Service are entirely fictitious. Any resemblance to real persons, organisations or proceedings, living or dead, current or historic, is coincidental.

7.2 Nothing in the Service is legal advice. The AI judge, witnesses, opponents and feedback are simulations; their outputs may be wrong, incomplete or misleading and must not be relied on in real proceedings, in study assessed for credit, or for any decision affecting a real matter.

8. Data

8.1 The Owner processes your account data and session data, including hearing transcripts, feedback outputs and derived delivery observations, to run, secure and improve the Service, including reviewing beta sessions to diagnose problems and improve exercises and feedback quality.

8.2 The lawful bases for this processing are performance of this agreement (running the Service for you) and the Owner's legitimate interests in securing and improving a pre-release product. No special-category data is sought, and clause 4.4 prohibits submitting confidential material.

8.3 Voice audio is processed in real time to run the hearing. The Service does not retain raw voice audio. It may retain bounded derived delivery observations including speaking rate, pauses, automatically tagged hesitations, response timing, relative captured level, clipping, pitch variation and neutral laughter-event detections. These are training evidence, not an inference about emotion, confidence, personality or mental state. Hearing transcripts, derived observations, feedback outputs and account data are retained by the Owner for the duration of the beta and for up to three months after it ends, unless deleted earlier at your request.

8.4 The Service uses third-party processors to operate: hosting (Netlify), database and file storage (Supabase, London), speech-to-text for hearings (Speechmatics, EU endpoint), speech synthesis for hearings (Kugel, EU endpoint), error monitoring (Sentry, EU region), transactional email such as invitations, password resets and account notices (Resend: messages are dispatched from an EU region, but Resend's account data, message metadata and delivery logs are processed in the United States under its data processing agreement and transfer safeguards), and AI inference (Anthropic for the training exercises; EU-region models via Requesty EU for professional features). A current list is available from the data contact. Where any transfer outside the UK occurs it is safeguarded by adequacy regulations or standard contractual clauses.

8.5 You have the rights given by UK data protection law (including the UK GDPR): access, rectification, erasure, restriction, objection and data portability, and the right to complain to the Information Commissioner's Office (ico.org.uk). To exercise them, or to ask for your data to be deleted, contact chris@lextrapolate.com.

8.6 Testing data, including your sessions, transcripts and feedback outputs, may be deleted at the end of the beta.

8.7 Fuller privacy information is available on request from the data contact (clause 8.5).

9. Term and termination

9.1 Either you or the Owner may end your participation in the beta at any time, for any reason, by notice (email suffices). The Owner may also suspend or end the beta as a whole at any time.

9.2 On termination your access ends and your licence under clause 6.2 ends. Clauses 3 (confidentiality), 5 (feedback licence), 6.1 (IP) and 7 (fictitious content; no legal advice) survive.

10. General

10.1 These terms are the whole agreement between you and the Owner about the beta and replace any earlier discussions about it.

10.2 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or the beta.
